Right of withdrawal

1. Cancellation policy / returns

You can revoke your contract declaration within 7 days by stating your reasons in writing by email and / or by returning the item using the return form. The set deadline starts after you receive the product. The timely dispatch of the cancellation or the goods is sufficient to meet the cancellation deadline. The revocation must be sent to the following address.

Pascal Bach

Neunbrunnenstrasse 38

8050 Zurich

1.2. Consequences of the withdrawal

Exercising the right of withdrawal leads to the conversion of the sales contract into a reverse transaction, according to which the services received under the sales contract must be reimbursed. Goods received are to be returned no later than 7 days after the declaration of cancellation. We will also reimburse you for payments received within 7 days of the declaration of cancellation. However, we can refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.

Please note that we do not grant a right of withdrawal for the following products:

  • Returns of used items.

  • Item without or with damaged original packaging.

  • Transport damage (more on this under 1.3.)

In the case of a return for no reason, this must also be noted in keywords. You have to bear the costs for the return. We will refund the purchase price immediately upon receipt of the goods. We reserve the right to deduct compensation for possible damage or excessive wear and tear from the purchase price to be reimbursed if any loss in value is due to handling of the goods that was not necessary to determine the type, quality and functionality of the goods.

If a consignment is returned to us by the post for the following reasons, the order will be automatically canceled after notification to the customer:

  • Package was not picked up

  • Unknown receiver

In special cases, the parcel can be sent again, but a fee of CHF 10.70 will be charged for this.

1.3. Damage or loss
Did your order arrive defective?
If you receive a damaged item of mail, bring the damaged product with the outer packaging and stuffing material to the local post office immediately and fill out a damage report there.

Request a copy and send it to us as a photo or scanned in so that you can claim your right to intact goods.
Damage that is not externally visible must be reported to the responsible post office in your community within 7 days of delivery.

Haven't you received your order?

If the shipment is not received by the customer within 5 days of receipt of the shipping confirmation, it is the customer's duty to notify us immediately.

An investigation into the shipment of a customer will only be initiated by the sender if the customer has duly notified this.

However, if the customer has not properly reported the lack of delivery, an investigation must be initiated directly at Swiss Post by the customer himself.

Conditions

The following general terms and conditions apply to all contracts, deliveries and other services. Deviating, conflicting or additional terms and conditions are not part of the contract.

1. Shipping

We always send with the Swiss Post. We calculate the shipping costs according to the current prices of the provider.

2. Offer

All articles are available according to the availability display on the product pages. A maximum of one product / shisha per person can be purchased in the online shop.

Small optical deviations from the images of the goods are possible.

The vase is a plastic product. Fine traces of processing or scratches cannot be ruled out and do not constitute a right to exchange. If the goods are in perfect condition, they can be returned and refunded.

3. Payments and deliveries

The final price of the order includes VAT plus the specified shipping costs. As a rule, your articles will be shipped immediately after the purchase amount has been credited to our account. You will also receive a dispatch note by email. Claims for damages due to delay or impossibility or non-fulfillment, including those that arose up to the withdrawal from the contract, are excluded.

By completing the order, the buyer accepts our payment terms and the payment options we have specified.

4. Retention of title

The goods ordered remain in the seller's possession until they have been paid for in full.

5. Warranty / Guarantee

We guarantee that the goods are free of material and manufacturing defects at the time of the transfer of risk and that they have the contractually guaranteed properties. Upon receipt of the goods, the buyer must immediately check them for quality and defects. Obvious defects must be reported to us in writing within 7 working days. The guarantee and warranty period is 12 months.

In the event of a complaint, the complained article must be sent in with sufficient postage. The warranty does not cover normal wear and tear. It expires if the customer changes the delivered goods. During the warranty period, the buyer has the right to free rework. A partial or complete exchange of the article is permissible. If defects are not remedied within a reasonable period, the buyer has the right to rescission or reduction.

Excluded from all guarantee and warranty obligations are:
Wear parts such as sealing rings, rubber caps, natural wear and tear such as scratches, rust, loss of paint etc., careless handling of products, incorrectly used products / application errors, items without a purchase receipt, are all excluded from the guarantee.

Air inclusions such as bubbles and production-related structures in glasses cannot be avoided and are therefore not a reason for complaint.

6. Age of majority

By accepting the terms and conditions, the customer confirms that he has reached the age of 18. Expenses for returns, etc. which arise from incorrectly specifying the date of birth are fully borne by the customer or his legal representative.

7. Conclusion of the contract

The presentation of the products in the online shop is not a legally binding application, but only represents a non-binding online catalog.

The purchase contract is concluded as soon as your order has been accepted by the seller, either through delivery of the goods or notification of delivery to the buyer.

8. Final provisions

The place of performance is Zurich. The business has the right to sue the customer in any other court. Swiss law applies. If the customer is a merchant or legal entity under public law, Aadorf is the exclusive place of jurisdiction for all disputes arising from this contract. The same applies if the customer does not have a general place of jurisdiction or domicile in Switzerland or domicile or habitual abode are not known at the time the action is brought.

9. Severability Clause

Should any provision of these terms and conditions be or become ineffective, this shall not affect the effectiveness of all other provisions or agreements. Rather, wholly or partially ineffective regulations should be replaced by a regulation that is legally effective and corresponds most closely to the ineffective in terms of content and reason.
